1. Agreement to These Terms
These Terms of Service apply to your use of rasberry.ca, the Rasberry™ Account Management Portal, and services provided by Tensioncore™ Administration Services dba Rasberry™ Web Services.
By accessing the website, creating an account, using the Account Management Portal, ordering services, paying an invoice, submitting a support request, or using any Rasberry™ service, you confirm that you have read, understood, and agree to these Terms of Service and the Rasberry™ Privacy Policy.
If you are using Rasberry™ on behalf of a business, organization, or other person, you confirm that you have authority to accept these terms on their behalf.
2. Who We Are
Rasberry™ Hosting and Rasberry™ Web Services are operated by Tensioncore™ Administration Services dba Rasberry™ Web Services.

3. Eligibility and Accounts
You must be at least 18 years old to create an account, purchase services, or use paid Rasberry™ services.
When you create or use an account, you agree to:
- Provide accurate and current account, contact, and billing information
- Keep your login credentials secure
- Use strong passwords and reasonable security practices
- Keep your email address current so important account, billing, service, security, and cancellation notices can reach you
- Accept responsibility for actions taken through your account, portal access, services, virtual servers, or credentials
- Notify Rasberry™ promptly if you suspect unauthorized access or misuse of your account or services
Rasberry™ may suspend, restrict, or terminate accounts that provide false information, violate these terms, create risk to the platform or other customers, or are used for illegal, abusive, harmful, or unauthorized activity.
4. Services
Rasberry™ provides web hosting, virtual server hosting, infrastructure services, account management tools, customer support, and related web services as described on the website, in the Account Management Portal, during checkout, on an invoice, or in a written service agreement.
The services, features, resources, prices, plan names, limits, and availability shown on the website or portal may change from time to time.
Service availability may depend on payment status, account verification, resource availability, network availability, upstream providers, successful provisioning, IP address availability, infrastructure health, and customer configuration.
Rasberry™ may refuse, cancel, hold, suspend, or review an order where necessary for billing, fraud prevention, legal compliance, security, abuse prevention, resource availability, operational stability, or platform protection.
5. Provisioning and Service Activation
Some services may be provisioned automatically through the Account Management Portal. Other services may require review, manual setup, verification, additional information, or operational approval.
A successful order or payment does not guarantee that a service can be provisioned exactly as requested. If Rasberry™ cannot reasonably provide a purchased service, Rasberry™ may cancel the order, offer an alternative, issue a credit, or provide a refund where appropriate.
Customers are responsible for reviewing service details, login information, assigned IP addresses, firewall settings, resource limits, operating system details, and configuration shown in the portal.
6. Payments, Billing, and Taxes
Customers agree to pay all charges shown at checkout, on an invoice, in the Account Management Portal, or in a written service agreement.
Accepted payment methods are those made available by Rasberry™ at checkout, on the invoice, or through the applicable payment process. Rasberry™ may use third-party payment processors such as Square or other providers.
Payment processors may have their own terms and privacy policies. Rasberry™ is not responsible for payment processor outages, declined payments, card issuer decisions, bank delays, or third-party payment processing errors.
Prices may not include applicable taxes, fees, currency conversion costs, bank fees, payment processor fees, or other charges unless specifically stated.
If payment is late, declined, reversed, disputed, fraudulent, or otherwise not received, Rasberry™ may suspend, restrict, admin-lock, cancel, or terminate services and accounts where appropriate.
7. Renewals and Service Terms
Service periods, renewal behavior, payment timing, and cancellation rules are determined by the plan, checkout flow, invoice, service agreement, or billing arrangement that applies to the specific service.
Some services may renew automatically if automatic billing is enabled. Other services may require manual payment, invoice payment, or renewal through the portal or another approved method.
Customers are responsible for monitoring their services, invoices, renewal dates, billing status, and payment method status.
8. Cancellations
Customers may request service cancellation through the Account Management Portal, support channels, email, or another method made available by Rasberry.
Cancellation requests are requests only. Submitting a cancellation request does not automatically cancel billing, shut down a virtual server, delete hosted data, remove DNS records, remove firewall rules, reverse a payment, refund charges, or hard-delete an account.
Cancellation requests are reviewed and processed by Rasberry. Rasberry™ may need to confirm account authority, service identity, billing status, active disputes, outstanding charges, data-retention requirements, or other operational details before processing a cancellation.
When a cancellation is processed, service access may end, hosted data may be removed, virtual servers may be stopped or deleted, network rules may be removed, and related service records may be closed or archived. Customers are responsible for exporting or preserving any data they need before cancellation is completed.
Unless a specific plan, invoice, agreement, or law requires otherwise, prepaid services may continue until the end of the paid service period and may not be refundable.
9. Account Deletion Requests
Customers may request account deletion through the Account Management Portal or another available support channel.
Account deletion requests are reviewed by Rasberry™ and are not automatic. Rasberry™ may need to retain certain account, billing, invoice, payment, audit, abuse-prevention, security, tax, accounting, legal, dispute, or service history records even after an account deletion request has been processed.
Account deletion may require active services to be cancelled first. Account deletion may also permanently remove access to service history, portal access, support records, and hosted resources where deletion is completed.
10. Customer Content and Data
Customers are responsible for the websites, applications, files, databases, email, software, scripts, services, users, credentials, configuration, and other content they upload, store, transmit, publish, or run through Rasberry™ services.
Customers retain responsibility for making sure their content and use of services complies with applicable law, these Terms of Service, acceptable use requirements, and any third-party rights.
Customers are responsible for maintaining their own independent copies of important content, configuration, credentials, software, and data unless a separate written agreement specifically says otherwise.
Rasberry™ is not responsible for loss of customer content caused by customer actions, customer configuration, compromised credentials, malware, software defects, third-party services, expired services, cancellation, non-payment, misuse, or events outside Rasberry's reasonable control.
11. Acceptable Use
Customers may not use Rasberry™ services, systems, networks, IP addresses, accounts, or infrastructure for illegal, harmful, abusive, disruptive, or unauthorized activity.
Prohibited activity includes, but is not limited to:
- Spam, unsolicited bulk messaging, phishing, spoofing, or fraudulent activity
- Malware, botnets, credential theft, ransomware, malicious scripts, or command-and-control activity
- Unauthorized scanning, probing, exploitation, attacks, denial-of-service activity, or attempts to bypass security controls
- Hosting or distributing illegal content or content that infringes the rights of others
- Activity that harms, disrupts, overloads, or degrades Rasberry™ systems, networks, infrastructure, customers, or upstream providers
- Attempts to gain unauthorized access to accounts, systems, services, networks, consoles, management tools, or data
- Using services in a way that causes excessive complaints, abuse reports, blocklisting, reputation damage, or operational risk
- Reselling, sharing, or transferring services in a way that violates these terms or creates unmanaged abuse, support, billing, or security risk
- Interfering with portal controls, billing systems, provisioning systems, firewall controls, service limits, or administrative safeguards
Rasberry™ may investigate suspected abuse and may suspend, restrict, admin-lock, filter, block, remove, or terminate services where reasonably necessary to protect Rasberry, customers, networks, systems, upstream providers, or the public.
12. Security, Suspension, and Administrative Controls
Rasberry™ may take administrative action where reasonably necessary for security, abuse prevention, billing, legal compliance, infrastructure stability, platform safety, or operational protection.
Administrative action may include:
- Suspending or restricting account access
- Suspending, stopping, locking, isolating, or disabling services
- Blocking or removing firewall rules, network access, or abusive traffic
- Restricting customer actions in the Account Management Portal
- Marking a service as administratively locked
- Limiting or disabling console, provisioning, power, firewall, or service-management actions
- Removing or disabling content, software, scripts, or services where required for safety, security, abuse prevention, or legal compliance
Rasberry™ will use reasonable judgment when taking administrative action. In urgent cases, action may be taken before notice is provided in order to protect systems, customers, networks, or third parties.
13. Customer-Managed Configuration
The Account Management Portal may allow customers to view or manage service details, power state, console access, firewall rules, assigned IP addresses, or other service configuration.
Customers are responsible for the effects of configuration changes they make or request. Incorrect firewall, network, operating system, application, credential, or service configuration may cause downtime, data exposure, service interruption, security issues, or loss of access.
Rasberry™ may provide tools and visibility to assist customers, but customers remain responsible for managing their own software, operating systems, users, credentials, hosted content, and service configuration unless a separate written managed-service agreement says otherwise.
14. Maintenance and Service Availability
Rasberry™ may perform scheduled or emergency maintenance to protect, update, repair, improve, or operate services, systems, networks, security controls, or infrastructure.
Maintenance may affect service availability. Where practical, Rasberry™ may provide notice through the website, Account Management Portal, status or maintenance banners, email, or other reasonable channels.
Rasberry™ aims to provide reliable services, but does not guarantee uninterrupted, error-free, or perfectly secure operation. Unless a separate written service level agreement applies, no specific uptime guarantee, service credit, or availability remedy is provided.
15. Third-Party Services and Providers
Rasberry™ may rely on third-party providers for payment processing, connectivity, software, infrastructure, certificates, licensing, support tools, or other services required to operate the platform or provide customer services.
Third-party services may be subject to their own terms, limits, availability, policies, outages, fees, or processing times. Rasberry™ is not responsible for failures, delays, outages, policy changes, or decisions made by third-party providers outside Rasberry's reasonable control.
16. Support
Rasberry™ may provide support through the Account Management Portal, email, contact forms, tickets, or other channels made available from time to time.
Support is provided according to service type, account status, support availability, operational priority, and the nature of the request. Rasberry™ does not guarantee that every configuration, software issue, customer application, third-party integration, operating system problem, or customer-caused issue can be resolved.
17. Intellectual Property
Rasberry™ names, marks, logos, website content, portal design, documentation, text, graphics, code, and related materials are owned by Tensioncore™ Administration Services or its licensors unless otherwise stated.
Customers may not copy, misuse, reverse engineer, interfere with, or misrepresent Rasberry™ branding, systems, documentation, website content, or portal functionality except as permitted by law or written permission.
18. Privacy
Rasberry™ handles personal information according to the Rasberry™ Privacy Policy.
By using Rasberry™ services, creating an account, submitting requests, or providing personal information, you agree to the collection, use, and handling of information as described in the Privacy Policy.
19. Limitation of Liability
To the maximum extent permitted by law, Rasberry™ and Tensioncore™ Administration Services will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business, loss of goodwill, loss of data, service interruption, or costs of substitute services.
Rasberry's total liability for any claim related to a service is limited to the amount paid by the customer for the affected service during the one month immediately before the event giving rise to the claim, unless a different limit is required by applicable law or a separate written agreement.
Nothing in these terms limits liability where liability cannot legally be limited.
20. Indemnity
Except where prohibited by law, customers agree to indemnify and hold harmless Tensioncore™ Administration Services dba Rasberry™ Web Services, its operators, employees, contractors, and service providers from claims, losses, damages, liabilities, costs, and expenses arising from:
- Customer use or misuse of services
- Customer content, software, configuration, accounts, credentials, or hosted systems
- Violation of these Terms of Service
- Violation of law or third-party rights
- Abuse, spam, security incidents, network attacks, or harmful activity caused by or originating from customer services
- Customer failure to secure accounts, systems, applications, or credentials
21. Consumer Protection and Mandatory Rights
Where the Business Practices and Consumer Protection Act, privacy law, consumer protection law, or other mandatory law applies and cannot be excluded, these terms will be read subject to those mandatory rights.
If there is a conflict between these terms and a mandatory legal right that cannot be waived, the mandatory legal right will apply.
22. Changes to These Terms
Rasberry™ may update these Terms of Service from time to time to reflect changes in services, pricing, billing practices, legal requirements, security requirements, business practices, or website and portal functionality.
Updated terms will be posted on rasberry.ca with a revised effective date. Where appropriate, Rasberry™ may provide notice through the Account Management Portal, email, status or maintenance banners, or other reasonable channels.
Continued use of Rasberry™ services after updated terms take effect means you accept the updated terms.
23. Governing Law
These Terms of Service are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
24. Severability
If any part of these Terms of Service is found to be invalid, unenforceable, or inconsistent with applicable law, that part will be interpreted, limited, or removed only to the extent necessary. The remaining parts of these Terms of Service will continue to apply.
